These Terms and Conditions govern your use of the Art House Dallas Cross Dock website and any cross-docking, cargo-handling, unloading, palletizing, restacking, storage, or related logistics services provided by Art House Dallas Cross Dock (“Art House,” “we,” “our,” or “us”).
By using our website, requesting a quote, scheduling a service, delivering cargo to our facility, or authorizing us to perform services, you agree to these Terms and Conditions.
1. Services
We provide cross-docking, emergency unloading, palletizing, restacking, downstacking, load consolidation, wrapping, storage, special-equipment handling, and other agreed cargo services.
The specific services, pricing, timing, and requirements for each job will be confirmed through a quote, service order, invoice, written message, or other agreement.
2. Quotes and Scheduling
Quotes are based on the information provided by the customer and may change if the cargo weight, dimensions, condition, quantity, equipment needs, labor requirements, waiting time, or scope of work differs from the information originally provided.
Scheduling is subject to availability. Estimated completion times are not guaranteed and may be affected by traffic, carrier delays, cargo condition, equipment availability, weather, safety concerns, or circumstances beyond our reasonable control.
3. Customer Responsibilities
The customer must provide complete and accurate shipment information, including cargo type, quantity, weight, dimensions, condition, handling instructions, appointment details, and any known hazards or special requirements.
The customer represents that they own the cargo or have proper authority to request services for it. Cargo must be properly documented, legally transported, and suitable for the requested handling or storage services.
4. Restricted Cargo
We may refuse hazardous, illegal, stolen, contaminated, improperly documented, perishable, temperature-sensitive, unusually valuable, or unsafe cargo unless we have approved it in writing before arrival.
The customer is responsible for disclosing hazardous materials, regulated goods, special handling requirements, and the value of unusually valuable cargo before services begin.
5. Access and Safety
Customers, drivers, carriers, and visitors must follow all facility rules, check-in procedures, posted instructions, and employee safety directions.
We may deny or restrict access when necessary to protect people, cargo, equipment, or property.
6. Payment
Payment is due according to the applicable quote, invoice, or service agreement.
Additional charges may apply for waiting time, overtime, additional labor, special equipment, storage, disposal, redelivery, reworking, or services outside the original scope.
We may require full or partial payment before releasing cargo or completing additional services. The customer is responsible for authorized collection costs and other lawful charges resulting from overdue amounts.
7. Cancellations and Delays
Customers should notify us as soon as possible about cancellations, rescheduling, missed appointments, or carrier delays.
Cancellation, waiting-time, labor, or equipment charges may apply when resources have already been reserved or work has begun.
8. Cargo Condition and Claims
Customers and carriers should inspect cargo before delivery to our facility and promptly after services are completed.
Any visible shortage, loss, or damage must be reported before the cargo leaves the facility whenever reasonably possible.
Claims must include supporting documentation, photographs, shipment records, invoices, and evidence of the claimed value. Failure to provide timely notice may limit our ability to investigate the claim.
9. Limitation of Liability
To the maximum extent permitted by law, Art House will not be responsible for indirect, incidental, special, punitive, or consequential damages, including lost profits, lost business, delivery penalties, or loss of use.
Art House is not responsible for loss or damage caused by concealed defects, inadequate packaging, ordinary wear, cargo characteristics, inaccurate instructions, carrier actions, government action, severe weather, power interruption, or events beyond our reasonable control.
Unless a different amount is agreed to in writing, our total liability relating to a service will not exceed the amount paid to us for the specific service giving rise to the claim.
Nothing in these Terms excludes liability that cannot legally be excluded or limited.
10. Indemnification
To the extent permitted by law, the customer agrees to indemnify and hold Art House harmless from third-party claims, damages, penalties, or expenses resulting from inaccurate shipment information, unlawful cargo, undisclosed hazards, improper packaging, lack of authority over the cargo, or the customer’s violation of these Terms.
11. Website Use
Website content is provided for general information and may be updated without notice.
You may not misuse the website, attempt unauthorized access, introduce malicious software, copy protected content for commercial use, or interfere with website operation.
12. Third-Party Services
Our website or services may involve independent carriers, drivers, contractors, payment providers, or other third parties.
We are not responsible for the independent conduct, websites, terms, or services of third parties that we do not control.
13. Privacy
Personal information collected through our website and services is handled according to our Privacy Policy, which is incorporated into these Terms by reference.
14. Governing Law
These Terms are governed by the laws of the State of Texas.
Any dispute relating to these Terms or our services will be brought in a court of competent jurisdiction located in Dallas County, Texas, unless applicable law requires otherwise.
15. Changes to These Terms
We may update these Terms periodically. The revised Terms will be posted on our website with an updated effective date.
Continued use of our website or services after an update constitutes acceptance of the revised Terms.
